Demented Media Refund Policy

Effective Date: January 1, 2025

This Refund Policy (“Policy”) governs all transactions for services provided by Demented Media, an Ohio-based independent film production company. By engaging with Demented Media (“Company,” “we,” “our,” or “us”), clients (“Customer” or “you”) acknowledge and agree to the terms outlined herein.

1. Ownership of Services

1.1 All services offered by Demented Media, including but not limited to film production, screenwriting, video editing, crowdfunding promotion, and the “Make Your Movie” package, remain the exclusive property of Demented Media until a final contract is executed.
1.2 No deliverable, draft, edit, or creative material may be used, published, or distributed until (a) the Customer has signed a final service agreement and (b) all payments have been made in full.

2. Deposits and Payment Terms

2.1 A non-refundable deposit is required before any services commence. The deposit amount will be specified in the applicable contract or invoice.
2.2 Remaining balances must be paid according to the payment schedule outlined in the executed contract.
2.3 Failure to make payments on time may result in suspension or termination of services, without entitlement to a refund.

3. Refund Eligibility

3.1 Pre-Work Cancellation: If a Customer cancels services prior to commencement of any work, a partial refund may be issued, less an administrative fee of ten percent (10%) of the total project cost.
3.2 Company Non-Performance: In the event Demented Media is unable to fulfill its contractual obligations due to circumstances solely attributable to the Company, the Customer shall be entitled to either:

• A full refund of all amounts paid, or

• A credit equal to the amounts paid, to be applied toward future services.
  3.3 Refunds will not be granted for delays or outcomes outside of the Company’s reasonable control, including but not limited to creative differences, third-party delays, or force majeure events.

4. Non-Refundable Services

4.1 Once work has begun (roughly 7 to 14 days after service is ordered), the following services are strictly non-refundable:

• Screenwriting (including drafting, revisions, and development)

• Video Editing & Post-Production

• Crowdfunding Promotion & Campaign Setup

• “Make Your Movie” Package (including budgeting, casting, crew hiring, and marketing)

• Any completed or partially completed creative deliverables (scripts, edits, promotional materials, or media files)

5. Customer Review and Approval

5.1 Customers will have opportunities to review drafts, edits, or proposals during the project timeline.
5.2 Revisions will be provided in accordance with the terms of the individual service contract.
5.3 Once a deliverable has been reviewed, approved, and finalized by the Customer, no further refunds will be issued under any circumstances.

6. Dispute Resolution

6.1 In the event of a dispute, both parties agree to make reasonable efforts to resolve the matter amicably.
6.2 If resolution cannot be achieved through mutual discussion, the dispute shall be handled in accordance with the governing law and jurisdiction specified in the signed service contract.

7. Amendments

7.1 Demented Media reserves the right to amend or update this Policy at any time. Any such changes will be effective upon posting to our official website.
